Plans exhibited for fourth time

Plans for a proposal to build a five-storey mixed-use shop-top residential development in Ettalong have been placed on exhibition for public comment for the fourth time.

The amended plans are for a proposed development at 302-308 Ocean View Rd, Ettalong.

They pertain to a requested review in the Lands and Environment Court of the Central Coast Council's refusal of the original application.

The case is identified as KHMS Corporation Pty Ltd v Central Coast Council, Land and Environment Court 2022/00044809.

When the proposal was first exhibited, it attracted a large number of adverse submissions from residents and was recommended for refusal by the Central Coast Council for 10 reasons.

Among them were that it did comply with the maximum height or maximum floor space ratio requirements of the planning provisions.

The Local Planning Panel refused the application on October 28, 2021, for the reasons listed by the Council plus another four reasons mainly involving inconsistency and lack of clarity in the supplied drawings.

In this request for a review of the determination, the application attempts to show that the plans are now consistent and adequate, that non-compliance has been minimised and that justification has been presented for variations to standards and to challenge subjective conclusions of the original decision.

It states that suitable arguments have been presented in line with at least one of the five so-called "Wehbe ways".

The exhibited documents include a set of re-modified drawings with annotated amendments and Nathers certificates.

A letter from the applicant's representative Wales and Associates stated that the Statement of Environmental Effects did not need to be amended because all of the necessary amendments were included in the attached documents.

The amendments on the drawings are numerous and mostly minor but include changes to the floor space ratio and a realignment of parking and retail levels.

Written submissions will be accepted until February 12.
