Three-unit proposal supported despite non-compliance
An application for a three-unit multi-dwelling development at 36 Kourung St, Ettalong, will be heard by the Local Planning Panel on Thursday, July 13.
The proposed development, with an estimated value of $1.16 million, has been recommended for approval by Council staff.
The application is non-compliant with front setback, street tree and retaining wall requirements.
A proposed front setback of 7.020 metres is a 1.43 metre or 17 per cent variation on the 8.45 metre requirement, being the average of the nearest two dwellings.
Retaining walls are up to 2.46 metres, when the requirement is that they be less than 0.600 metre below existing ground level.
Only one street tree replacement is proposed, where two are required per 15 metre frontage.
The council assessment claims that, nevertheless, the application complies with planning objectives.
The council staff report states that 15 submissions were received, with 11 being unique submissions four being duplicate submissions.
"Matters raised in public submissions, including parking, tree removal, overshadow, private open space, setbacks and amenity impacts," the report stated.
It says the applicant was asked to address issues in relation to visitor parking, setbacks, private open space and street trees.
"Following further discussions with the applicant, a set of amended plans were received on 17 May 2023."
The amended plans provided an additional visitor parking space in the front setback of the development, surrounded by landscaping.
They increased front, rear and side setbacks.
They re-configuration of Unit 1 to remove private open space behind the front setback and remove the bedroom from the ground floor.
An updated arborist report addressed the removal of a street tree within the proposed driveway.
"Given the change to the plans were minor and resulted in a marginally reduced scheme with no greater or additional impacts the plans were not re-notified."
