Panel approves DA involving council staff member
Local Planning Panel has approved a development application for land owned by a council staff member at 2 MacArthur Parade, Woy Woy, despite non-compliance with requirements for rear and side setbacks, and for solar access.
Rear setback was 70 per cent less than specified in the planning provisions, Eastern side setback was 50 per cent less, and sunlight access was 68.75 per cent less.
Approval was recommended by council planners.
The Panel resolved to grant consent for "Alterations and additions to existing dwelling, including attached secondary dwelling, subject to the conditions detailed in the schedule attached to the report and as amended by Council's supplementary memo of 21 June 2023, and having regard to the matters for consideration detailed in Section 4.15 of the Environmental Planning and Assessment Act 1979".
Reasons given were that the proposal satisfied the provisions of the relevant controls and that any potential environment impact is addressed by the proposed conditions of consent.
The Panel's decision was unanimous.
