Duplex proposes frontages to 'side' boundary

An application for a "proposed residential duplex at 34 Wallaby St, Blackwall" has been submitted to Central Coast Council, with the frontages to Commonweath Ave on the corner block.

The application prepared by Raybal Constructions states: "The site is of rectangular shape and has a total site area of 561 square metres with a site street frontage of 11 metres, sloping with a fall of approximately 0.5 metres from front to rear of property."

"Neither Wallaby St or Commonwealth Ave to the front or side of the property has any kerb or guttering."

"The site is situated within a residential area and the area is zoned R2: Low Density Residential under the Central Coast Local Environmental Plan 2022."

The western boundary is the long side of the property on Commonwealth Ave.

The property fronts Wallaby St to the north and an unnamed laneway at the rear.

The physical frontages of the two proposed units and their individual driveways are on Commonwealth Ave.

Calculations on the drawings indicate that the landscaped area is 234.44 square metres or 42 per cent of the site and a gross floor area of 257.28 square metres giving a floor space ratio of 0.46:1.

The application provides compliance tables for the main planning requirements of the Local Environment Plan but only for some of the requirements of the Development Control Plan.

The application refers to the Environmental Planning and Assessment Act, 1979, and states "the provisions contained in a DCP are to provide guidance and to be flexibly applied (Section 3.42)".

"Non-compliance can be addressed through alternative solutions or addressing how a proposal otherwise meets the objectives of the DCP or section."

A 1.4 m masonry fence is proposed for the northern boundary and 1.2 m masonry fence at the western boundary

From the site plan, it appears that six trees are to be removed, including one street tree which conflicts with the proposed driveway for Unit 1.
